College Fantasy League Terms

THE COLLEGE FANTASY LEAGUE IS ONLY OPEN TO RESIDENTS OF FLORIDA AND CALIFORNIA. PARTICIPATION IN THE COLLEGE FANTASY LEAGUE IS VOID WHERE PROHIBITED BY LAW, WHICH WSL RESERVES RIGHT TO DETERMINE AT ANY TIME. NO PURCHASE NECESSARY TO PARTICIPATE.

Welcome to College Fantasy League ("College Fantasy League"), owned and operated by Sponsor: Association of Surfing Professionals LLC d/b/a World Surf League ("WSL") whose registered office is at 147 Bay Street, Santa Monica, California 90405. WSL offers the College Fantasy League service to you subject to the conditions within these College Fantasy League Game Terms (“Game Terms”) (which supplement the WSL Fantasy Surfing Rules and Instructions, located at http://mct.fantasy.worldsurfleague.com/rules) (“Fantasy Rules”), and any other rules or guidelines that may be published by WSL on a periodic basis (any of which may be updated by WSL from time to time and be effective from the date of publication).

(A) ACCEPTANCE OF COLLEGE FANTASY LEAGUE TERMS: Any participation in the College Fantasy League will constitute your acceptance of these Game Terms; the WSL privacy policy accessible at https://www.worldsurfleague.com/pages/privacy-policy; the WSL Terms of Use accessible at https://www.worldsurfleague.com/pages/terms-conditions; and the Fantasy Rules for participation as stated on the WSL app, mobile or desktop (“WSL Website”). For the avoidance of doubt, College Fantasy League is a function of the WSL Website. Nothing within College Fantasy League Game Terms is intended to conflict with the other paragraphs of the WSL Terms of Use or the WSL Privacy Policy. IF YOU DO NOT AGREE TO ABIDE BY THE GAME TERMS, YOU CANNOT PARTICIPATE IN COLLEGE FANTASY LEAGUE OR BE ELIGIBLE TO RECEIVE THE PRIZE.

(B) REGISTRATION REQUIREMENT: To participate in the College Fantasy League, you must use an email account associated with your college (e.g. frothyjoe@College.edu) and the provided password. You must be over 18 years of age and be a resident of California or Florida only. If you have an existing WSL account, please sign out and register a new account. For further assistance, please contact support@worldsurfleague.com. If you do not have an email account associated with your college or if your college was not invited to participate in this College Fantasy League, you may not participate in the College Fantasy League at this time but you may still participate in WSL Fantasy Surfing accessible at www.worldsurfleague.com/fantasy. You will be prompted to register before being able to participate. Please note that if you are under the age of 18, you may not participate in the College Fantasy League or WSL Fantasy Surfing.

(C) HOW TO PLAY: You need to identify yourself with a college, and there can be an unlimited number of players from each college provided each player registers with a college associated email (e.g. frothyjoe@college.edu). The College Fantasy League shall commence on August 24th 2017 and shall end on December 21st 2017. Each player needs to select surfers they think will perform best for each Men’s Championship (“CT”) event remaining from the launch of the College Fantasy League on August 24, 2017, which events include, Hurley Pro at Trestles, Quiksilver Pro France, MEO Rip Curl Pro Portugal and Billabong Pipe Masters (each an “Event”). Selected surfer’s real heat scores in each Event count as points counted as each players individual College Fantasy League points (“Fantasy Points”). For example, if a surfer on your College Fantasy League team scores 15.05 in a heat, you’ll get 15.05 Fantasy Points. Your total is the combined Fantasy Points of all selected surfers from each Event. There are limits for which surfers you can pick. You will be prompted to select a requisite number of surfers from the respective three (3) “Tiers” of their CT ranking at the time of your selection (as available on the WSL Website) (“CT Ranking”):

  • Tier A: Pick 2 surfers from CT Rankings 1 – 8;
  • Tier B: Pick 4 surfers from CT Rankings 9 – 24; and
  • Tier C: Pick 2 surfers from CT Rankings 25 – 34.

Your selections for each respective Event must be submitted prior to the respective Event start time (see www.worldsurfleague.com). You will need to select new surfers for each Event, and repeat the process above using the updated CT Rankings.

(D) WINNING TEAM: Each college team will be scored by calculating the sum of the Fantasy Points earned by each player from that college. The Fantasy Points from the top 10 players for each college are calculated per Event. The sum of these top ten (10) scores will then be added to be an overall college score (“College Score”), which will be displayed on the College Fantasy League Leaderboard. At the end of the 2017 Men’s CT season, the college team with the highest cumulative College Score will be the “WSL College Fantasy League Champion”. The odds of winning depend on the number of participants in the WSL College Fantasy League. The Winners shall be notified via email sent to the address used to set up the Winners’ account by December 31, 2017.

(E) PRIZE: Six (6) players from WSL College Fantasy League Champion that had the highest cumulative Fantasy Points, as notified and confirmed by WSL (“Winners”), shall receive travel, accommodation and access for a day to the Kelly Slater Wave Pool at Surf Ranch in Lemoore, California (“Surf Ranch”) which shall include a private tour and lunch at Surf Ranch, (the “Prize”) on a date between February 1, 2018 – April 30, 2018, as chosen by WSL in its sole discretion. The approximate retail value of the total Prize being awarded to all of the Winners, in aggregate, shall be no more than ten thousand US dollars ($10,000 USD). There is no cash equivalent for the Prize. The Prize consists of only those items specifically described as included in the Prize. Prize includes (i) air travel (round trip, coach class), only for notified Winners whose residence is in Florida, from an airport closest in proximity to the Winner’s college residence and not another location; (ii) standard hotel accommodations on a double occupancy basis for one night; and (iii) round trip ground transportation to and from the airport and hotel. Travel restrictions and conditions may apply. Travel, accommodation and transfers as required shall be chosen by WSL in its sole discretion. WSL has not and will not be providing travel insurance or any other form of insurance. No refund or compensation will be made in the event of a cancellation or delay of any flight. All travel is subject to the terms and conditions set out in these Game terms and any set forth by the airline carrier of WSL’s choosing. Prize Winners must be able to travel on dates determined by WSL. Exact dates of travel to be determined by WSL in its sole discretion. The inability of a Prize player to redeem the Prize on the nominated date shall not give rise to an action in damages or otherwise or for the right to receive a substitute prize. By accepting the Prize, You agree to release WSL and its affiliates, including, without limitation the Kelly Slater Wave Company LLC (“Released Parties”) from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the College Fantasy League or for damages of any kind caused by the Prize or resulting from acceptance, possession, or use/misuse of Prize, or while preparing for, participating in, and/or traveling to and from any Prize-related activity. RELEASED PARTIES SHALL HAVE NO LIABILITY FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING FROM OR ARISING OUT OF ANY TRAVEL RELATED TO THE PRIZE OR ANY OTHER ASPECT OF THE PRIZE WINNER’S ACCEPTANCE OR USE OF THE PRIZE. Prize will be awarded “as is” with no warranty or guarantee, either express or implied, by WSL. Prize is non-assignable, non-transferable, and must be accepted as awarded. No substitutions may be made. WSL reserves the right to substitute the Prize for another prize of greater or equal value. All meals, ground transportation and incidentals not described herein will be the sole responsibility of the Winner.

(F) PRIZE CONDITIONS: All Winners are solely responsible for all applicable federal, provincial, and local taxes (if applicable) associated with the receipt of any Prize. Winners will be required to sign these terms and conditions, an affidavit of eligibility and a release and waiver and will be required to sign a further release of liability to enter and participate in activities at the Surf Ranch. Winners may also be required to provide further personal information as reasonably requested by WSL, in order to redeem the Prize. When receiving the Prize, if a Winner fails to agree to terms and sign the requisite documents or if a potential Winner is not in compliance with these Game Terms, then such person shall be disqualified, without any compensation, and, at WSL’s sole discretion, an alternate Winner may be selected as their replacement. Each potential Winner is subject to verification by WSL before any prize will be awarded and any decision taken by WSL is final and binding in all matters relating to the College Fantasy League. A participant is not a winner of a Prize unless and until participant’s eligibility has been verified and participant has been notified that verification is complete. You must be able to travel to Lemoore, California at the date chosen by WSL for redemption of the Prize.

(G) ACCURACY OF INFORMATION: ALL STATISTICS AND OTHER INFORMATION PROVIDED THROUGH COLLEGE FANTASY LEAGUE OR THROUGH OTHER WSL MEDIA (INCLUDING WSL WEBSITES) ARE UNOFFICIAL. The College Fantasy League and its components are offered for informational and/or entertainment purposes only. While WSL and the third parties used to provide services to permit the running of the College Fantasy League ("Third Party Providers") use reasonable efforts to include accurate and up-to-date information, neither WSL nor the Third-Party Providers warrant or make any representations of any kind with respect to the information provided to you through College Fantasy League. WSL and its Third-Party Providers shall not be responsible or liable for the accuracy, usefulness, availability or reliance of any information transmitted or made available via College Fantasy League, and shall not be responsible or liable for any error or omissions in that information.

(H) ENTERTAINMENT PURPOSES ONLY: College Fantasy League is for entertainment purposes only and may not be used in connection with any form of gambling or wagering.

(I) COLLECTION OF PERSONAL INFORMATION: By signing up for College Fantasy League, you agree to WSL's use of any personal information you provide as described in the WSL Privacy Policy (https://www.worldsurfleague.com/pages/privacy-policy).

(J) WSL'S RESERVATION OF RIGHTS: WSL expressly reserves the right to immediately modify, suspend or terminate your account and refuse current or future use of any WSL service on the WSL Website, including the College Fantasy League service, if WSL: (a) in its sole discretion, believes you have violated or tried to violate the rights of others; (b) becomes aware of information indicating a safety concern for you, other WSL users, or the general public, or (c) in its sole discretion, believes that you have acted inconsistently with the spirit or letter of the Game Terms, Terms of Use or the Rules and Instructions for College Fantasy League. College Fantasy League and its related benefits are offered at the sole discretion of WSL, and WSL has the right to modify or discontinue, temporarily or permanently, College Fantasy League, whether in whole or in part for any reason, with or without notice to you. You agree that WSL will not be liable to you or to any third party for any modifications or discontinuance of the College Fantasy League or Fantasy Surfing.

(K) SPECIFIC COLLEGE FANTASY LEAGUE INDEMNITY: Notwithstanding other indemnities provided within the Terms of Use, you agree to indemnify and hold harmless the Released Parties from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of, or participation in, College Fantasy League, your connection to the WSL Website (or any function therein), your violation of the Game Terms, the Terms of Use, the Rules and Instructions, or your violation of another person or entities rights.

(L) LIMITATIONS OF LIABILITY: WSL reserves the right, in its sole discretion, to cancel, terminate, suspend and/or modify the Prize or the College Fantasy League service, in whole or any part of it, at any time, without notice and to award prizes using all non-suspect eligible entries received as of the termination/suspension date, if any infection, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond WSL’s control, affects the integrity or proper conduct of the College Fantasy League. WSL reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process (if applicable) or the operation of the College Fantasy League or is considered by WSL in its sole discretion to be acting in violation of these Game Terms or in a disruptive manner. WSL assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. WSL is not responsible for lost, late, incomplete, illegible, incorrect, delayed, garbled, undelivered, or misdirected entries or the theft, destruction or unauthorized access to, or alteration of, entries; failures or malfunctions of data transmission systems; interrupted or unavailable network, server or other connections; any error, omission, interruption, defect or delay in any transmission or communication; or any technical problem; typographical, printing or other errors or omissions in these Game Terms or in advertisements or other materials, or other problems or errors of any kind whether computer, network, mechanical, human, electronic, typographical, printing or otherwise relating to or in connection with the College Fantasy League, including, without limitation, errors or problems which may occur in connection with the administration of the College Fantasy League, in the processing of entries, in the selection or announcement of winners or in the awarding of the Prize. WSL’s failure to enforce any term of these Game Terms shall not constitute a waiver of that provision. In the event of a dispute regarding the identity of an individual who confirmed participation, the entry will be deemed submitted by the Authorized Account Holder of the email account held by WSL. “Authorized Account Holder” is defined as the natural person who is assigned to an email account by an internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Players will comply with any request by WSL to show proof of being the Authorized Account Holder.

(M) LICENSE OF RIGHTS AND PUBLICITY AS WINNER: You hereby consent to WSL’s use of your name, likeness, photograph, any possible footage, photographs and video, voice, opinions, hometown and/or state for promotional purposes in any media, worldwide, (including but not limited to internet and television broadcast) in perpetuity, without further consent or compensation except where prohibited so that WSL can identify you in the College Fantasy League and promote your progress. If you are a Winner, you agree that WSL can describe you as a winner of the College Fantasy League in association with WSL or some description similar to the same.

(N) OTHER TERMS & CONDITIONS: By participating in the College Fantasy League, you agree to be bound by these Game Terms and agree that Released Parties and their designees and assigns and all of their respective officers, directors, employees, representatives and agents shall have no liability and you will indemnify, defend and hold Released Parties harmless from any liability, loss, injury, or damage to you themselves or any other person or entity, including personal injury, death or damage to personal or real property, to you or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of the Prize (including any prize activity or travel related thereto) or participation in this College Fantasy League. You further acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee express or implied, in fact or in law, relative to the prize, including, but not limited to, its quality or fitness for a particular purpose.

(O) DISPUTES: By participating in the College Fantasy League, you agree that: 1.) Any and all disputes, claims, and causes of action arising out of or connected with the College Fantasy League, or any Prize awarded, shall be resolved individually, without resort to any form of class action; 2.) Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in the College Fantasy League but in no event attorneys’ fees. 3.) Under no circumstances will you be permitted to obtain any award for, and you hereby waive all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. 4.) All issues and questions concerning the construction, validity, interpretation and enforceability of these Game Terms, Rules and Instructions or the rights and obligations of you, Released Parties and WSL in connection with the College Fantasy League, shall be governed by, and construed in accordance with the laws of the State of California. Any legal proceedings arising out of this College Fantasy League or relating to these Game Terms shall be instituted only in the federal or state courts of California, and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to the College Fantasy League. 5.) The invalidity or unenforceability of any provision of these Game Terms shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Game Terms shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. In the event of any inconsistency between these Game Terms and the WSL Terms of Use governing the use of the WSL Website, in relation to the College Fantasy League, the terms of these Game Terms shall prevail. Except where inconsistent or specifically stated, the Terms of Use shall apply in whole to the College Fantasy League.

For a list of winners, which should be available after December 26th 2017, please send a self addressed envelope for receipt to the WSL Registered Address. ALTHOUGH WSL MAY HAVE EMPLOYEES WHO HAVE BEEN STUDENTS AT PARTICIPATING COLLEGES, WSL IS NOT ASSOCIATED OR AFFILIATED WITH ANY COLLEGE PARTICIPATING IN THE COLLEGE FANTASY SURF LEAGUE.
